Over Half Convicted in Colorado Hit-and-Run Cases Avoid Prison Time

According to a report in the Denver Post, since January 2008, less than half of those convicted in Colorado hit-and-run accidents are sentenced to prison. Most recently, Erin Jackson, a former teacher, only spent a single night in jail after she ran a red light, hit a 16-year-old East High School student with her car and sped away, leaving the seriously injured girl in the middle of East Colfax Avenue.

“The entire justice system is full of compromise,” said the judge who presided over Jackson’s case. “Sometimes people in my position have to swallow things that are distasteful. Let me tell you, Ms. Jackson, not sending you to jail is extremely distasteful. You should be locked up.”

However, in the end, Jackson avoided prison time, instead receiving five years of probation and 350 hours of community service for her crime.

Since 2008, according to an analysis of judicial records, the charge of leaving the scene of an accident involving serious bodily injury has been filed 461 times. Of those 461 charges, 281 of them were dismissed. In addition, during the same period, 80 charges of leaving the scene of an accident involving death have been filed, and of those 80, 31 were later dismissed.

Lawmakers, for their part, have in 2008 and 2012 passed legislation increasing the penalty for leaving the scene of an accident involving death and serious injury.

However, it should not take this sort of legislation to prevent drivers from leaving the scene of a car accident. They should know better, but sometimes, even when they do, they still make the kind of mistakes that cause fatal car accidents.
