A Colorado Springs, Colorado woman is being charged with first-degree murder after she left her 9-month-old son in a bathtub while she ran across the street to pick up cigarettes and chicken wings.
Estella Toleafoa, 23, says she left Erich with his 2-year-old brother in the bathtub with an inch of water in it while she went across the street to buy milk, according to police. The affidavit states that Toleafoa did not buy milk, though. She went to Kwik Stop Plus and bought cigarettes. Before going home, she stopped in next door at Pizza and Wings to get some chicken wings. She estimates she was gone for 10 to 20 minutes.
She arrived home to find the tub half full with the hot water running and Erich floating face down. She says she tried to revive the child, but could not, and called 911.
Police said that when they arrived Erich was on the living room floor with what appeared to be scalding burn marks on his body. They also found a ring around the inside of the bathtub that appeared to be a residue of Erich’s skin.
Erich’s father is in the U.S. Army, currently deployed in Afghanistan.
